Surveyor's Right-of-Entry Bill (SB1468) is Now a Law and More!

We have good news to share! The Right-of-Entry Bill (SB1468) that HLSA has been working on since 2022 was signed by the Governor and became law (Act 209) on July 3. This Bill protects Surveyors from charges of criminal trespass under certain circumstances and conditions outlined in Act 209. Click on the following link to get a copy of Act 209.

Additionally, HLSA has been made aware of another bill related to trespassing via a UAS – Act 58 –  which was enacted on June 5. HLSA feels that the surveying community may not be aware of this new law. However, Act 58 will inevitably affect how surveyors conduct their operations as UAS plays an increasing role in surveying. In short, if a UAS crosses a property line and comes within 50ft of a dwelling to coerce, intimidate, or harass another person then the operator can be charged with trespass with a drone, a misdemeanor offense. HLSA is looking forward to working on our next legislative goal, a Statute of Repose, in the upcoming Legislative Session. We are creating a working group to address this legislation.
